The protection of your privacy is very important to us, which is why NEUGEL DIVISIONS treats your personal data carefully, trustworthy and respectfully. We collect personal data to provide better service to our valued customers and to constantly improve the user experience on the websites and online shops as well as in NEUGEL DIVISIONS apps. NEUGEL DIVISIONS always adheres to the applicable data protection laws when dealing with your personal data. This privacy policy provides you with a clear overview of when NEUGEL DIVISIONS collects data about you for what purposes when you visit the websites or stores or use NEUGEL DIVISIONS apps, and how NEUGEL DIVISIONS uses the data you provide. We also explain to whom personal data is disclosed and what choices and legal rights you have when processing your personal data.

2) Protection of personal data

NEUGEL DIVISIONS uses data networks that are protected by industry-standard firewalls and password systems, among other things, to ensure the security and confidentiality of the personal data collected. NEUGEL DIVISIONS automatically collects personal data when you interact with and use our websites, online shops or apps. Which data is collected can be seen from the respective input forms.

3.1 Data collected automatically

NEUGEL DIVISIONS collects personal data when you use our websites, online shops or apps without registering or actively submitting information.

  • Websites:
    Your browser transmits data to us when you visit a NEUGEL DIVISIONS website. The data is also stored in the log files of our system. This data is not stored together with other personal data. The following data is collected:
    • which NEUGEL DIVISIONS website is visited;
    • number of visits as well as date, time and duration of the visit;
    • source or reference from which page the page is accessed;

The storage in log files is to ensure the functionality of the website. In addition, the data serves us to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. In the case of the storage of data in log files, this is the case after at most one month. Further storage is possible. In this case, the IP addresses of the users are deleted or alienated, so that an assignment of the calling client is no longer possible.

The collection of data for the provision of the website and the storage of data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object.

  • Cookies:

Your personal data will only be processed by NEUGEL DIVISIONS for the purpose of answering or the purpose of the form and stored for technical administration. After the processing is completed, your inquiry or other form of contact will be deleted, provided that there are no legal retention periods to the contrary.
  • Customer account:
    You have the option to create a customer account. To make the use of our websites pleasant for you, NEUGEL DIVISIONS uses a "single sign-on" procedure (see section 1 below).   • Contract data (including contract date, contract type, contract content; contracting parties; contract term; contract value; claims asserted from contract);
  • Purchase information (including purchase date; place of purchase; time of purchase; type, quantity and value of goods and services purchased; shopping cart; abandoned shopping cart; payment methods used; payment point; purchase history);
  • Customer service information (including returns of goods, complaints, warranty cases, delivery information);
  • Session data relating to visits to our websites, mobile device apps or offers on internet platforms, multimedia portals or social networks (including duration and frequency of visits, language and country preferences, information about browser and computer operating system, internet protocol addresses, search terms and search results; submitted ratings);
  • location-based data when using mobile devices.

A customer account can be deleted at any time by using the delete function or button in the customer account or by sending a message to the controller (see section 1 above). After complete processing of the contract or deletion of your customer account, the data will be blocked with regard to tax and commercial retention periods and deleted after the retention period has expired, unless you have expressly consented to further use of your data or a legally permitted data use by us has been reserved, about which we have informed you.

  • Participation in raffles, prize draws, surveys, etc.:
    If you wish to participate in a raffle, prize draw, or survey, etc., NEUGEL DIVISIONS may ask you for further personal data, such as your postal address, in order to send you the prize. The data collected and the purpose for which it is collected will be apparent from the respective input forms. Personal data collected for raffles, prize draws, or surveys, etc. will generally be deleted as soon as the purpose of the measure has been fulfilled.

 

4) Purpose of data processing by NEUGEL DIVISIONS

Your personal data will be used by NEUGEL DIVISIONS for the following purposes.

4.1   NEUGEL DIVISIONS "Single Sign-On" 

The personal data you provide to NEUGEL DIVISIONS when you first register will be used for identification and authentication purposes for all our services. Therefore, you can use the same login credentials from any location and with any device. Our systems are able to identify you regardless of your location via the global Single Sign-On. This means that you do not need to re-register if you want to use a new NEUGEL DIVISIONS internet service or are in a different country.

4.2   Provision of goods and services by NEUGEL DIVISIONS

NEUGEL DIVISIONS uses your personal data to process orders and contracts, including sending order and shipping confirmations, delivery confirmations, delivery, and invoicing.

NEUGEL DIVISIONS processes personal data from you and other persons, where permitted and where we deem it appropriate, also for the following purposes, in which we (and sometimes also third parties) have a legitimate interest corresponding to the purpose:

  • Sending advertising, newsletters, or promotional mailings, as well as organizing and conducting competitions or prize draws, including notification and publication of winners via NEUGEL DIVISIONS websites, multimedia portals, or social networks;
  • Organization and execution of special occasions such as events and promotional events;
  • Avoiding unnecessary advertising through insights gained from the analysis of customer behavior for individualized and personalized direct marketing;
  • Individualized and personalized or anonymous and group-based identification, classification, and analysis of current and potential customer needs and customer interests;

  • if NEUGEL DIVISIONS is legally obliged to disclose data or within the scope of legal proceedings (court order or order of an enforcement authority, etc.).

5.2   Order processing and credit checks

Your data will be disclosed by NEUGEL DIVISIONS,

  • if companies perform services for NEUGEL DIVISIONS, such as package delivery, payment processing, and customer service, insofar as this is necessary for the delivery of the goods/services.

    • The shipping and delivery of packages can be carried out by a shipping service provider such as Swiss Post, DHL (Deutsche Post AG), DPD (DPD Deutschland GmbH), UPS (United Parcel Service Deutschland Inc. & Co), etc.
    • Your email address will be passed on before the delivery of the goods for the purpose of coordinating a delivery date or for announcing the delivery, provided you have given your express consent for this in the ordering process. Otherwise, for the purpose of delivery, only the recipient's name and delivery address will be passed on to the shipping service provider. The disclosure only takes place to the extent necessary for the delivery of the goods. In this case, prior coordination of the delivery date with the shipping service provider or the transmission of status information on the shipment delivery is not possible.   • if this is necessary for payment processing, payment data will be passed on to the commissioned credit institution as part of payment processing. The disclosure only takes place to the extent that this is necessary for payment processing.

    • For credit card payments, your payment data will be passed on to the following payment solutions as part of payment processing:
      • PowerPay, MFGroup.
    • For payments via PayPal, we pass on your payment data as part of payment processing to PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal").   • to protect the legitimate interest in determining the creditworthiness of our customers and to prevent fraud and other abusive uses in connection with payments. In such cases, NEUGEL DIVISIONS reserves the right, especially if NEUGEL DIVISIONS makes advance payments (e.g., delivery on account), as well as the involved credit institutions, to check payment transactions or to carry out a credit check. For this purpose, internal and external information sources are used or passed on to credit agencies. If there is a suspicion of abusive actions and/or such are detected, NEUGEL DIVISIONS also reserves the right to pass on the corresponding information (including personal data) to other companies of the NEUGEL DIVISIONS Group, which can also check the data for their purposes.

You can object to this processing of your data at any time by sending a message to the data controller or the credit institution, but NEUGEL DIVISIONS or the credit institution may still be entitled to process your personal data if this is necessary for contractual payment processing.

5.3   Analysis and Marketing Activities

NEUGEL DIVISIONS discloses your data to third parties

  • to send direct advertising with your consent or for legitimate interests (see section 6 below);
  • if you have not restricted the use of cookies when visiting the NEUGEL DIVISIONS website, NEUGEL DIVISIONS uses third-party analysis tools and services to carry out online marketing or web analysis (see section 7 below);
  • if you ask NEUGEL DIVISIONS to share your personal data with third-party websites or platforms - such as social networking websites. 6) Use of personal data for direct advertising

6.1   Registration for the email newsletter

You have the option to subscribe to various email newsletters (e.g., about products, product news, job vacancies, etc.) from NEUGEL DIVISIONS by providing your email address to regularly receive information about our offers or vacant job positions. Providing further details, e.g., first name and last name, is voluntary and is used to address you personally.

6.2   Sending the email newsletter to existing customers

NEUGEL DIVISIONS is legally permitted to send you offers for similar goods or services from our range, such as those already purchased, by email without your explicit consent, if you have provided NEUGEL DIVISIONS with your email address when purchasing goods or services.

You are entitled to prohibit the use of your email address for the aforementioned advertising purpose at any time with effect for the future by confirming the link in the email, with which you can unsubscribe from the distribution list, or by notifying the data protection officer. After receipt of your objection, the use of your email address for advertising purposes will be stopped immediately. 

7) Online marketing and web analysis services

The anonymized data recorded when you visit our website using cookies can be used for analysis purposes and to optimize the website in connection with third-party services. This allows these third parties to collect personal data about NEUGEL DIVISIONS users to a limited extent, for example, by recognizing them using their own cookies or logins.

NEUGEL DIVISIONS uses the following third-party services for online marketing and web analysis services:

Web analysis tools provide statistics and graphics that provide information about the use of our internet pages and the browsing behavior of our users. 7.1   Google Tools

The DoubleClick online marketing tool uses cookies to serve relevant ads to users, to improve campaign performance reports, or to prevent a user from seeing the same ads multiple times. Through a cookie ID, Google records which ads are served in which browser and can thus prevent them from being displayed multiple times. In addition, DoubleClick can use cookie IDs to record so-called conversions that are related to ad requests. This is the case, for example, when a user sees a DoubleClick ad and later visits the advertiser's website with the same browser and buys something there. According to Google, DoubleClick cookies do not contain any personal information.

Due to the Google tools used, your browser automatically establishes a direct connection with Google's server. NEUGEL DIVISIONS has no influence on the scope and further use of the data collected by Google through the use of this tool.

Google complies with Swiss and EU data protection regulations and has registered with the US Department of Commerce for the "Swiss-U.S. Privacy Shield" and "EU-U.S. Privacy Shield" (information on the Privacy Shield can be found at https://www.privacyshield.gov). Google will only transfer this data to third parties due to legal regulations or within the framework of order data processing.

To avoid being tracked by analytics services, you must adjust your browser settings to block corresponding cookies (see section 3.1: Browser customization regarding the use of cookies). 7.3 Facebook Tools (Facebook Audience, Facebook Pixel)

The Facebook pixel is an analytics tool that measures the effectiveness of Facebook ads. It helps to understand what actions people take on the website. The collected data is anonymous for NEUGEL DIVISIONS, meaning it does not allow conclusions about the identity of users. However, the data is stored and processed by Facebook, so a connection to the respective user profile is possible, and Facebook can use the data for its own advertising purposes, in accordance with Facebook's Data Policy (https://www.facebook.com/about/privacy/). These processing operations only take place with express consent.

Facebook Inc., based in the USA, is certified for the "Privacy Shield" data protection agreement between the USA-EU and USA-Switzerland, which ensures compliance with the level of data protection applicable in Switzerland and the EU.

To deactivate the use of cookies on your computer, you can set your internet browser so that no more cookies can be stored on your computer in the future or that already stored cookies are deleted. 8) Use of social media: social media plugins

8.1 "Single Sign-on" procedure using a social media account

NEUGEL DIVISIONS may enable you to use your login data from your social network user account (e.g., Facebook or Google+) to create a customer account or for registration purposes. When social media plugins are used, personal data of users is transmitted to the providers of social networks.

When you access a NEUGEL DIVISIONS website that contains such a plugin, your browser establishes a direct connection with the servers of the corresponding social network. The content of the plugin is transmitted directly from the social network to your browser and integrated into the page. Through this integration, the social network receives the information that your browser has accessed the corresponding page of our website, even if you do not have a profile with the corresponding social network or are not currently logged in. 8.1.2 Google+ Sign-In

The "Google+ Sign-In" social plugin is operated by the social network Google+, a company of Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google+"). You can recognize the "Google+ Sign-In" or "Register with Google" social plugins on our website by a red button with the Google+ logo and the inscription "Google Sign-In" or "Register with Google" or "Sign in with Google" or "Login with G."

By using this Google+ button on our website, you also have the option to log in or register on our website using your Google+ user data. Only if you give your express consent to the exchange of data with Google before the login process, based on a corresponding notice, will we receive the general and publicly accessible information stored in your profile from Google+, depending on your personal privacy settings on Google+. This information includes the user ID, name, profile picture, age, and gender.

Please note that after changes to Google+'s privacy policy and terms of use, if consent is given, your profile pictures, the user IDs of your friends, and your friends list may also be transferred if these have been marked as "public" in your privacy settings on Google+. 8.2 Use of Social Media via "Social Media Plugins"

NEUGEL DIVISIONS may use social media plugins, e.g., from social networks like Facebook, Google+, Twitter, or Instagram, on the website. These platforms have their own data protection regulations, over which NEUGEL DIVISIONS has no influence.

To enhance the protection of your data when visiting the NEUGEL DIVISIONS website, two different mechanisms have been integrated:

  • 2-Click Solution (Facebook, Google+, Twitter)
    The social network plugins are initially deactivated and embedded into the page using a so-called "2-click" solution. Deactivated plugins appear pale or grayed out. Deactivated plugins do not yet establish a connection with the social network's servers. Only when you activate the plugins do you give your consent to the data transfer, whereby your browser establishes a direct connection to the social platform's servers. The content of the respective plugin is transmitted directly to your browser and integrated into the page. The plugin then transmits data (including your IP address) to the social network. NEUGEL DIVISIONS has no influence on the scope of data that the social network collects with the help of the plugins. By integrating the plugins, the social network receives information that your browser has accessed the corresponding page of our website, even if you do not have a profile with the corresponding social network or are not currently logged in. The collected information (including your IP address) is transmitted directly from your browser to a server of the social network and stored there. If you interact with the plugins, the corresponding information is also transmitted directly to a social network server and stored there. The information is also published in your profile on the social network and displayed to your contacts there.
  • Shariff Solution (LinkedIn, Instagram)
    The buttons of the social networks LinkedIn and Instagram are embedded into the page using an HTML link. This type of embedding ensures that when a page of our website containing such buttons is accessed, no connection is yet established with the social network's servers. When you click on the button, a new browser window opens and calls up the social network's page, where you can interact with the plugins there (possibly after entering your login data).

You can revoke your consent at any time by reactivating the activated plugin by clicking on it again, or by logging out of the social network and closing the website. However, the revocation has no influence on the data already transferred to the social network.

The social networks listed below have concluded the "Privacy Shield" data protection agreement between USA-EU and USA-Switzerland and are thus certified to ensure compliance with the level of data protection applicable in Switzerland and the EU.

8.3 Use of Youtube Videos

NEUGEL DIVISIONS uses the YouTube embedding function to display and play videos from the provider "YouTube," which belongs to Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

The extended data protection mode is used here, which, according to the provider, only initiates the storage of user information when the video(s) are played. When embedded YouTube videos start playing, the provider "YouTube" uses cookies to collect information about user behavior. According to "YouTube," these serve, among other things, to record video statistics, improve user-friendliness, and prevent abusive actions. If you are logged in to Google, your data will be directly assigned to your account when you click on a video. If you do not wish to be associated with your YouTube profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation is carried out in particular on the basis of Google's legitimate interests in displaying personalized advertising, market research, and/or tailoring its website to needs. You have a right to object to the creation of these user profiles, and you must contact YouTube to exercise this right.

Regardless of whether embedded videos are played, a connection to the Google network "DoubleClick" is established each time this website is accessed, which can trigger further data processing operations without our influence.

9) Children as users of the websites

In principle, we do not knowingly collect personal data about children and adolescents under 16 years of age. Should we become aware that we have inadvertently collected personal data about children and adolescents under 16 years of age, we will take steps to delete this information as soon as possible, unless we are obliged to retain it under applicable law.

If we are aware that a child is over 16 years old but is considered a minor under applicable law, we will obtain the consent of the parents/guardians before using the child's personal data.

 

10) Storage period

NEUGEL DIVISIONS retains personal data only as long as this is considered necessary to comply with applicable laws and to protect our rights (statutory retention period, e.g. commercial and tax law retention periods) or as long as they are necessary for the purposes for which they were collected.

In particular, NEUGEL DIVISIONS stores the personal data collected from customers, observing the following deadlines and then deletes them, provided that there are no legal or operational retention obligations/reasons to the contrary, or we have informed you in advance about different storage periods:

  • Data collected during a purchase in the online shop is generally kept for 10 years after the last processing operation for accounting reasons;
  • Data from correspondence, for example via the contact form, is kept for six weeks after the last processing operation and then deleted;
  • Applicant data will be deleted after 6 months in case of a rejection. If the applicant has agreed to further storage of personal data, the data will be kept in our systems and deleted at the latest after two years. If an applicant gets a job, the data will be transferred to a personnel information system.
  • Personal data collected by NEUGEL DIVISIONS for marketing measures or web analyses will be deleted as soon as they are no longer needed and in any case after the expiry of the maximum statutory retention period. As a rule, deletion takes place one month after collection.
  • Data collected for the provision of the website will be deleted when the respective session ends. If the data is stored in log files, this will be the case after one month at the latest.

 

11) Storage location and international transfer of your personal data

NEUGEL DIVISIONS stores and processes your personal data in Switzerland.

However, there will also be cases in which NEUGEL DIVISIONS must transfer your personal data within the European Union (EU), where an adequate level of data protection applies, or outside the European Economic Area ("EEA") to a country that does not guarantee the same level of data protection as the country in which you normally use our products and/or services. If the personal data you provide when registering a NEUGEL DIVISIONS account or when using the NEUGEL DIVISIONS website is processed outside the European Union or the EEA, we will take appropriate steps to ensure the adequate protection of your personal data.

If the level of data protection in a country does not correspond to that in Switzerland, we will contractually ensure that the protection of your personal data always corresponds to that in Switzerland. We ensure this by one or more of the following measures:

 

12) Right to inspect, amend and delete your personal data

NEUGEL DIVISIONS has implemented mechanisms to enable you to exercise your legal rights with regard to your personal data.

Upon receipt of your request to the person responsible (see section 1 above) and sufficient information to confirm your identity, we will provide you with a copy of the personal data we hold about you, for which you have a legal right to information. In addition, we will inform you about the purposes for which this personal data is used, the recipients of your personal data and the origin of the information.

You can contact NEUGEL DIVISIONS in writing at any time to request changes to certain personal data that you consider to be incorrect or irrelevant, or to ask us to block, delete or otherwise remove your personal data in accordance with applicable law. We will update, block, delete or remove your personal data upon request in accordance with applicable law.

You also have the option of withdrawing your consent to the corresponding marketing activities and marketing communications to which you have consented to NEUGEL DIVISIONS. Marketing communications contain a simple way to unsubscribe from receiving further communications in the future, such as a link via which you can unsubscribe. You can unsubscribe according to the information in the respective communication you received via a specific channel or via the settings of your NEUGEL DIVISIONS customer account. Alternatively, you can also contact us directly using the contact details provided.

Please note that even after your request to block or delete your personal data, we may have to retain some of it within the framework of our legal or contractual retention obligations (e.g. for billing purposes) and in this case will only block your personal data to the extent necessary for this purpose. Furthermore, deleting your personal data may mean that you can no longer continue to receive or use the services you have registered for. Under certain circumstances, you have the right to request that we provide you or a third party designated by you with your personal data in a common format.
