The protection of your privacy is very important to us, which is why NEUGEL DIVISIONS treats your personal data carefully, trustworthily and respectfully. We collect personal data to provide better service to our valued customers and to continuously improve the user experience on the websites and online shops as well as in NEUGEL DIVISIONS apps. NEUGEL DIVISIONS always adheres to applicable data protection laws when handling your personal data. This privacy policy provides you with a clear overview of when and for what purposes NEUGEL DIVISIONS collects data about you when you visit the websites or stores or use NEUGEL DIVISIONS apps, and how NEUGEL DIVISIONS uses the data you provide. NEUGEL DIVISIONS uses data networks protected by industry-standard firewalls and password systems, among others, to ensure the security and confidentiality of the personal data collected. When handling your personal data, we take appropriate technical and organizational measures to protect your data from loss, misuse, unauthorized access, disclosure, alteration or destruction.

NEUGEL DIVISIONS automatically collects personal data when you interact with and use our websites, online shops or apps. 3.1 Data that is collected automatically

NEUGEL DIVISIONS collects personal data when you use our websites, online shops or apps without registering or actively transmitting information.

  • Websites:
    Your browser transmits data to us when you visit a NEUGEL DIVISIONS website. The data is also stored in our system's log files. This data is not stored together with other personal data. The following data is collected:
    • which NEUGEL DIVISIONS website is visited;
    • number of visits and date, time and duration of the visit;
    • source or referrer, from which page the page is accessed;

Storage in log files is done to ensure the functionality of the website. In addition, the data serves to optimize the website and to ensure the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.

The data will be deleted as soon as they are no longer required to achieve the purpose for which they were collected. In the case of data collection for the provision of the website, this is the case when the respective session has ended. In the case of storing data in log files, this is the case after one month at the latest. Further storage is possible. In this case, the IP addresses of the users are deleted or alienated so that an assignment of the calling client is no longer possible.

The collection of data for the provision of the website and the storage of data in log files is absolutely necessary for the operation of the website. Consequently, the user has no possibility to object.

  • Cookies:
    NEUGEL DIVISIONS and NEUGEL DIVISIONS partners use cookies to enable the use of various functions. Cookies are small text files that are stored on your computer's hard drive by your browser. Your personal data will only be processed by NEUGEL DIVISIONS for the purpose of answering or the purpose of the form and stored for technical administration. After completion of the processing, your inquiry or other form of contact will be deleted, unless there are legal retention obligations to the contrary.
  • Customer account:
    You have the option to create a customer account. To make the use of our websites pleasant for you, NEUGEL DIVISIONS uses a "single sign-on" procedure (see section 1 below).   • Purchase information (including purchase date; place of purchase; time of purchase; type, quantity and value of goods and services purchased; shopping cart; abandoned shopping cart; payment methods used; payment point; purchase history);
  • Customer service information (including returns of goods, complaints, warranty cases, delivery information);
  • Session data related to visits to our websites, apps for mobile devices or offers on internet platforms, multimedia portals or social networks (including duration and frequency of visits, language and country preferences, information about browser and computer operating system, internet protocol addresses, search terms and search results; submitted ratings);
  • location-based data when using mobile devices.

A customer account can be deleted at any time and can be done using the delete function or button in the customer account or by sending a message to the responsible person (see section 1 above). After complete processing of the contract or deletion of your customer account, the data will be blocked with regard to tax and commercial retention periods and deleted after the retention period has expired, unless you have expressly consented to further use of your data or a legally permitted data use by us has been reserved, about which we have informed you.

  • Participation in raffles, prize draws, surveys, etc.:
    If you wish to participate in a raffle, prize draw, survey, etc., NEUGEL DIVISIONS may ask you for further personal data, such as your postal address, in order to send you the prize. The data collected and the purpose for which it is collected are specified in the respective entry forms. Personal data collected for raffles, prize draws, surveys, etc. are usually deleted as soon as the purpose of the measure has been fulfilled.

 

4) Purpose of data processing by NEUGEL DIVISIONS

Your personal data will be used by NEUGEL DIVISIONS for the following purposes.

4.1 NEUGEL DIVISIONS "Single Sign-On"

The personal data you provide to NEUGEL DIVISIONS when you first register will be used for identification and authentication purposes for all our services. Therefore, you can use the same login credentials from any location and with any device. Our systems are able to identify you regardless of your location via global Single Sign-On. This means that you do not have to re-register if you want to use a new NEUGEL DIVISIONS internet service or are in another country.

4.2 Provision of NEUGEL DIVISIONS goods and services

NEUGEL DIVISIONS uses your personal data to process orders and contracts, including sending order and shipping confirmations, delivery confirmations, delivery and invoicing.

NEUGEL DIVISIONS processes your personal data and that of other persons, where permitted and deemed appropriate by us, also for the following purposes, in which we (and sometimes third parties) have a legitimate interest corresponding to the purpose:

  • Sending of advertising, newsletters or promotional mailings, as well as organizing and conducting competitions or prize draws, including notification and publication of winners via NEUGEL DIVISIONS websites, multimedia portals or social networks;
  • Organization and execution of special events such as events and promotional events;
  • Avoiding unnecessary advertising through insights from the analysis of customer behavior for individualized and personalized direct marketing;
  • Individualized and personalized or anonymous and group-related identification, classification and analysis of current and potential customer needs and customer interests;

5.2 Order processing and credit checks

Your data is transferred by NEUGEL DIVISIONS,

  • when companies perform services for NEUGEL DIVISIONS, such as package delivery, payment processing and customer service, as far as this is necessary for the delivery of the goods/services.

    • Shipping and delivery of packages can be carried out by a shipping service provider such as Swiss Post, DHL (Deutsche Post AG), DPD (DPD Deutschland GmbH), UPS (United Parcel Service Deutschland Inc. & Co), etc.
    • Your email address will be forwarded before the delivery of the goods for the purpose of coordinating a delivery date or for delivery notification, provided that you have given your express consent to this in the order process. Otherwise, only the recipient's name and delivery address will be forwarded to the shipping service provider for the purpose of delivery. The forwarding only takes place insofar as this is necessary for the delivery of the goods. In this case, a prior coordination of the delivery date with the shipping service provider or the transmission of status information about the shipment delivery is not possible. Your consent can be revoked at any time with effect for the future towards the controller (see section 1 above) or towards the transport service provider.
  • if this is necessary for payment processing, payment data will be passed on to the commissioned credit institution within the framework of payment processing. The transfer only takes place insofar as this is necessary for payment processing.

    • For credit card payments, your payment data will be processed by the following payment solutions:

In such cases, NEUGEL DIVISIONS, especially if NEUGEL DIVISIONS provides services in advance (e.g. delivery on account), as well as the involved credit institutions reserve the right to check payment transactions or carry out a credit check. For this purpose, internal and external sources of information are used or passed on to credit agencies. If there is a suspicion of abusive actions and/or such are detected, NEUGEL DIVISIONS also reserves the right to pass on the corresponding information (including personal data) to other companies of the NEUGEL DIVISIONS Group, which can also check the data for their purposes.

You can object to this processing of your data at any time by sending a message to the data controller or the credit institution, but NEUGEL DIVISIONS or the credit institution may still be entitled to process your personal data if this is necessary for contractually agreed payment processing.

5.3 Analysis and Marketing Activities

NEUGEL DIVISIONS shares your data with third parties

6) Use of personal data for direct marketing

6.1 Registration for the email newsletter

You have the option to subscribe to various email newsletters (e.g. about products, product news, job vacancies, etc.) from NEUGEL DIVISIONS by providing your email address in order to regularly receive information about our offers or vacant positions. 6.2 Sending of the email newsletter to existing customers

NEUGEL DIVISIONS is legally permitted to regularly send you offers for similar goods or services from our range, such as those already purchased, by email without your explicit consent, if you have provided NEUGEL DIVISIONS with your email address when purchasing goods or services.

You are entitled to prohibit the use of your email address for the aforementioned advertising purpose at any time with effect for the future by confirming the link in the email, with which you can unsubscribe from the distribution list, or by notifying the data protection officer. After receipt of your objection, the use of your email address for advertising purposes will be stopped immediately.

7) Online marketing and web analysis services

The anonymized data, which are recorded when you visit our website by means of cookies, can be used for analysis purposes and for optimizing the website in connection with third-party services. This allows these third parties to collect personal data about NEUGEL DIVISIONS users to a limited extent, for example by recognizing them using their own cookies or logins.

NEUGEL DIVISIONS uses the following third-party services for online marketing and web analysis services:

Web analysis tools provide statistics and graphics that provide information about the use of our internet pages and the surfing behavior of our users. 7.1 Google Tools

The DoubleClick online marketing tool uses cookies to serve relevant ads to users, to improve campaign performance reports, or to prevent a user from seeing the same ads multiple times. Google uses a cookie ID to record which ads are displayed in which browser and can thus prevent them from being displayed multiple times. In addition, DoubleClick can use cookie IDs to record so-called conversions that are related to ad requests. This is the case, for example, when a user sees a DoubleClick ad and later visits the advertiser's website with the same browser and buys something there. According to Google, DoubleClick cookies do not contain any personal information.

Due to the Google tools used, your browser automatically establishes a direct connection with Google's server. NEUGEL DIVISIONS has no influence on the scope and further use of the data collected by Google through the use of this tool.

Google complies with Swiss and EU data protection regulations and has registered with the US Department of Commerce for "Swiss-U.S. Privacy Shield" and "EU-U.S. Privacy Shield" (for information on Privacy Shield, please visit https://www.privacyshield.gov). Google will only transfer this data to third parties due to legal requirements or within the scope of data processing on behalf of a controller.

To opt out of the analysis services' tracking process, you must adjust your browser settings to block corresponding cookies (see Section 3.1: Browser settings for cookie usage). 7.3 Facebook Tools (Facebook Audience, Facebook Pixel)

Facebook Inc., based in the USA, is certified under the "Privacy Shield" data protection agreement between the USA-EU and USA-Switzerland, which ensures compliance with the data protection level applicable in Switzerland and the EU.

To deactivate the use of cookies on your computer, you can set your internet browser so that no more cookies can be stored on your computer in the future, or already stored cookies are deleted. 8) Use of Social Media: Social Media Plugins

8.1 "Single Sign-on" Procedure using Social Media Accounts

NEUGEL DIVISIONS may allow you to use your social network user account login data (e.g., Facebook or Google+) to create a customer account or for registration purposes. When social media plugins are used, personal data of users is forwarded to the social network providers.

If you access a NEUGEL DIVISIONS website that contains such a plugin, your browser establishes a direct connection to the servers of the corresponding social network. The content of the plugin is transmitted by the social network directly to your browser and integrated into the page. 8.1.2 Google+ Sign-In

8.2 Use of Social Media via "Social Media Plugins"

NEUGEL DIVISIONS may use social media plugins on the website, e.g., for social networks such as Facebook, Google+, Twitter, or Instagram. These platforms have their own data protection regulations, over which NEUGEL DIVISIONS has no influence.

To enhance the protection of your data when visiting the NEUGEL DIVISIONS website, two different mechanisms have been integrated:

  • 2-Click Solution (Facebook, Google+, Twitter)
    The social network plugins are initially deactivated and integrated into the page using a so-called "2-click" solution. Deactivated plugins appear pale or are grayed out. Deactivated plugins do not yet establish a connection with the social network servers. Only when you activate the plugins do you give your consent to the data transfer, whereby your browser establishes a direct connection to the social platform's servers. The content of the respective plugin is transmitted directly to your browser and integrated into the page. The plugin then transmits data (including your IP address) to the social network. NEUGEL DIVISIONS has no influence on the scope of data that the social network collects with the help of the plugins. Through the integration of the plugins, the social network also receives information that your browser has accessed the corresponding page of our website, even if you do not have a profile with the corresponding social network or are not currently logged in. The collected information (including your IP address) is transmitted by your browser directly to a server of the social network and stored there. If you interact with the plugins, the corresponding information is also transmitted directly to a social network server and stored there. The information is also published in your profile on the social network and displayed there to your contacts.
  • Shariff Solution (LinkedIn, Instagram)
    The buttons for the social networks LinkedIn and Instagram are integrated into the page using an HTML link. This type of integration ensures that when a page of our website containing such buttons is accessed, no connection to the social network's servers is yet established. If you click on the button, a new browser window opens and calls up the social network page, where you can interact with the plugins there (possibly after entering your login data).

You can revoke your consent at any time by deactivating the activated plugin again by clicking it, or by logging out of the social network and closing the website. However, the revocation has no effect on the data that has already been transferred to the social network.

The social networks listed below have concluded the "Privacy Shield" data protection agreement between the USA-EU and USA-Switzerland and are thus certified to ensure compliance with the data protection level applicable in Switzerland and the EU.

8.3 Use of YouTube Videos

NEUGEL DIVISIONS uses the YouTube embedding function to display and play videos from the provider "YouTube," which belongs to Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google").

The extended data protection mode is used here, which, according to the provider, only initiates the storage of user information when the video(s) are played. If the playback of embedded YouTube videos is started, the provider "YouTube" uses cookies to collect information about user behavior. According to "YouTube," these are used, among other things, to record video statistics, improve user-friendliness, and prevent abusive practices. If you are logged into Google, your data will be directly assigned to your account when you click on a video. If you do not wish for the association with your YouTube profile, you must log out before activating the button. Google stores your data (even for users who are not logged in) as usage profiles and evaluates them. Such an evaluation is carried out in particular on the basis of Google's legitimate interests in displaying personalized advertising, market research, and/or demand-oriented design of its website. You have a right to object to the creation of these user profiles, and you must contact YouTube to exercise this right.

Regardless of the playback of the embedded videos, a connection to the Google network "DoubleClick" is established each time this website is accessed, which can trigger further data processing operations without our influence.

9) Children as users of the websites

As a matter of principle, we do not knowingly collect personal data about children and adolescents under 16 years of age. Should we become aware that we have unintentionally collected personal data about children and adolescents under 16 years of age, we will take steps to delete this information as soon as possible, unless we are obliged to retain it under applicable law.

If we know that a child is over 16 years old but is considered a minor under applicable law, we will obtain the consent of the parents/guardians before using the child's personal data.

10) Storage period

NEUGEL DIVISIONS retains personal data only as long as is deemed necessary to comply with applicable laws and to protect our rights (statutory retention periods, e.g. commercial and tax law retention periods) or as long as it is necessary for the purposes for which it was collected.

In particular, NEUGEL DIVISIONS stores personal data collected from customers, observing the following periods, and then deletes it, unless there are legal or operational retention obligations/reasons to the contrary, or we have previously informed you about different storage periods:

  • Data collected during a purchase in the online shop is generally stored for 10 years after the last processing operation for accounting reasons;
  • Data from correspondence, for example via the contact form, is stored for six weeks after the last processing operation and then deleted;
  • Applicant data is deleted after 6 months in case of rejection. If the applicant has consented to further storage of the personal data, the data will be stored in our systems and deleted after two years at the latest. If an applicant gets a job, the data is transferred to a human resources information system.
  • Personal data collected by NEUGEL DIVISIONS for marketing measures or web analyses will be deleted as soon as it is no longer needed and in any case after the expiry of the legally prescribed maximum retention period. As a rule, deletion takes place one month after collection.
  • Data collected for the provision of the website is deleted when the respective session ends. In the case of data storage in log files, this is the case after one month at the latest.

11) Storage location and international transfer of your personal data

NEUGEL DIVISIONS stores and processes your personal data in Switzerland.

However, there will also be cases in which NEUGEL DIVISIONS will have to transfer your personal data within the European Union (EU), where an adequate level of data protection applies, or outside the European Economic Area ("EEA") to a country that does not guarantee the same level of data protection as the country in which you generally use our products and/or services. You can contact NEUGEL DIVISIONS in writing at any time to request changes to certain personal data that you consider to be incorrect or irrelevant, or to ask us to block, delete or otherwise remove your personal data in accordance with applicable law. We will update, block, delete or remove your personal data upon request in accordance with applicable law.

You also have the option to withdraw your consents to the relevant marketing activities and marketing communications that you have consented to with NEUGEL DIVISIONS. The marketing communications contain a simple way to unsubscribe from receiving further communications in the future, such as a link through which you can unsubscribe. You can unsubscribe according to the information in the respective communication you received via a specific channel or via the settings of your NEUGEL DIVISIONS customer account. Alternatively, you can also contact us directly using the contact details provided.

Please note that even after your request to block or delete your personal data, we may have to retain some of it within the framework of our legal or contractual retention obligations (e.g. for billing purposes) and in this case will only block your personal data as far as necessary for this purpose. Furthermore, deleting your personal data may mean that you can no longer continue to receive or use the services you have registered for.
